    摘要: 近年來，國內生態保育意識高漲，人民對於政府在保育政策的制定及執行上要求日增，而各地方政府多以封溪護漁措施，執行溪流生態保育政策，但地方政府由於財源日益窘迫，及為滿足公民參與公共事務的需求，如何在高度複雜性、動態性及多樣性的社會政治中，達到政策執行的最佳效果，1990年代後期興起的新治理強調多元主體協商，由高權行政決行改為協商勸服及網絡治理，不再以政府為主體，轉而尋求私部門以外的第三部門的合作，共同承擔責任，且共同授予權利及分享利益，才能達成政策的有效執行。
    本研究係以新北市平溪區的封溪護漁為研究對象，以協力治理為理論基礎，探討封溪護漁執行過程中，公部門與第三部門的協力治理模式，雙方對於協力治理的認知與態度，協力部門之間的互動關係，以及封溪護漁永續經營之策略。
    本研究以文獻分析法對協力治理理論作初步探討外，並進入研究個案場域做實地觀察，再對個案中之對象進行深入訪談，獲取研究所需的資料做分析，最後發現新北市平溪區封溪護漁協力治理運作過程中，協力部門所遭遇之困難，公部門因應的策略，並研擬出封溪護漁永續發展之策略，以供政府部門實施封溪護漁協力治理政策之參考。

    This study is based on Pingxi District, New Taipei City seal Creek fishing protection for the study, to third-governance as the theoretical basis to discuss the closure fishing protection the implementation process, the public sector and the third sector third-governance model of governance for third parties knowledge and attitude, the interaction between third sector, as well as sealing creek fishing protection strategies of sustainable management.
    In this study, literature analysis on third-governance theory makes a preliminary study, the case study field and enter the field observations made, and then the case of the object depth interviews, access to research data required for analysis, and finally found Pingxi, New Taipei City River fishing protection zone closure third course of treatment, the difficulties encountered by third sector, public sector coping strategies, and to develop a sustainable development of the fishing protection Creek closure strategy for government departments to implement governance policies closure Creek third reference .
