    Abstract:  本論文欲探討日本與中華民國法律對於身心障礙者就業保障的法源,舉出日本國憲法第13條(幸福追求權)、第14條(平等權)、第25條(生存權)、第27條(勞動權)與中華民國憲法第7條(平等權)、第15條(生存權、勞動權)、第155條(救濟制度)、憲法增修條文第10條(身心障礙者保護)進行歸納整理,比較異同。
     並提出雙方的身心障礙者福利法規,包括日本的「障害者總合支援法」、「障害者基本法」以及台灣的「身心障礙者權益保護法」進行歸納整理,並附上世界身障國際福利條約的變遷。接著提出日本的醫療自我負擔問題與台灣的公務人員身心障礙特考問題。
     最後則附上目前正在就業的身心障礙者之訪談紀錄,以及淡江大學盲生資源中心的就業取向問卷整理,以期成為更完整並具說服力之論文。
    This study in about the Disabilities Employment in Japan and Taiwan. First, investigate the Constitution in Japan and Taiwan, find the different points.
    Second, investigate the Services and Supports for Persons with Disabilities Act in Japan and the People with Disabilities Rights Protection Act in Taiwan, summarizing content.
    At last, interview the disabilities who are working and collection questionnaire from the students with disabilities to understand their real needs.
