    摘要: 在現今的社會中,絕大部分的法律案子都必需使用之前相似案例來進行參考,更何況是工程法律這種複雜性較高的案例更需要之前的判例來參考。 除此之外,刑事案件有刑法、民事案件有民法,而工程法律並沒有直接專屬的法律條文,因此更需要借用相似判例來參考,由於工程法律案例本身多而複雜,所以本研究希望提供一個快速查詢案例的方法。
    本研究主要以主題地圖(Topic Maps)為架構,軟體使用Inxight Star Tree Studio當使用者介面來進行動態操作,目的就是為了製作一個提供用戶端一個動態、圖像化、方便上手的查詢方式,以增進使用者查詢之效率。
    「主題地圖」(Topic Maps)是藉由主題、關聯及資源指引來表達知識,用來管理大量非組織化資訊的工具,其中包含了三個核心元素,主題 (Topic)、關聯 (Association) 與資源指引 (Occurrence),可簡稱為TAO模型。
    本研究之資料庫架構主要以每個工程案例為主,案例之資料表為該案例之總結果,工程之資料表為基本工程資料,延遲與賠償資料表為該案例發生的原因,天數與金額判決為該案例之判決結果,以此為藍圖架構成本研究之資料庫。
    本研究上每一個主題地圖上的主題都有其相關性,比如:詞彙間彼此有相關關係,舉例每一個案例都有該其延遲原因,每個延遲原因都有其延遲天數,因此借由這些相關方式可以有效找出自身所想要的資訊,又或者具有從屬或等級關係,舉例判決法院與其相關有地方法院、高等法院等。
    本研究建立資料庫主要存取工程法律案子上有關工期展延與工程賠償兩個部分上的案例資料,讓使用者查詢該案例工程之展延天數或者賠償金額是為多少,也可以反過來想知道相同延遲原因有哪些案例與被判決的案例有哪些相關法令等。
    本研究之資料內容共有三十個案例,查詢系統除了可使用主題地圖之關聯式查詢縮小搜尋範圍已達到查詢案例外還有一般式的查詢,一般式查詢主要運用關鍵字查詢方式,藉由五種不同之搜尋模組來查詢目標。
    In today''s society, most of the legal trials use previous similar cases for references. Not to mention the technically complex lawsuits of construction engineering projects, legal precedents are even more important. In addition, criminal trials have criminal law and civil suits have civil law. However, construction engineering lawsuits don’t have dedicated legal provisions, and therefore need to rely on similar precedents. Due to the complexity and quantity of construction legal cases, this research is intended to provide a quick way of querying cases.
    This research is based on the topic map architecture, using Inxight Star Tree Studio as user interface for dynamic, graphical and easy-to-use query operation, to enhance query efficiency. Topic map is a knowledge representation method used to manage large amount of unorganized information using three core elements, topic, association and occurrence, referred to as the TAO model.
    The database schema of this research is mainly built around each construction project. The case table is the overall result of the project, the engineering table contains the basic engineering data of the project, the delay and claim table is the cause of the incident, the day and the compensation table is the verdict of the case.
    Every topic on topic maps has its relevance that is correlation between vocabularies. For example, a case has its cause of delay, and each cause of delay has the number of days delayed. Likewise, the correlation can be subordinate or hierarchical relationships. For example, a ruling court can be a district court, high court, etc. Information can then be found efficiently through these relationships consequently.
    The scope of the research is limited to legal cases regarding construction time extension and money compensation, which allows users to query the number of days extended and/or the amount of claims. On the other hand, queries can also be made to cases with same delay reason or with same law provisions.
    Total of 30 cases are in the database of this research. The query system offers not only the topic map query mode that use links to browse and narrow down related cases, but also a general query mode that searches the database using keywords from five different search modules.
