    Abstract: 基於我國並無專責機關負責各法規命令對市場競爭限制的檢視工作,更
    基於此一工作於我國將屬先期推動,因此本計畫將以設計簡約清晰容易上手
    之檢視手冊為主軸,提供各部會於既有與新設法規之檢視工作,一個易懂的
    初步操作型圖冊。所謂初步檢視,就是透過本計劃所羅列設計之查核樣態問
    題,一一思考並回答,若該有任一樣態問題之回答,呈現出"有可能"顯著
    限制市場競爭之結果,則該政策就必需進一步做更詳盡的衝擊評估(Impact
    assessment) ,並且提出各可能替代方案,尋出能夠達成相同目標但衝擊競爭
    最小的方案,以為執行依據。這一競爭評估檢視手冊( Competition assessment
    toolkit) ,其目的不在於反對或撤除它部會或許必要的管制設限,而是在於促
    使各部會對於所擬定或所執行之管制設限,能夠對市場競爭構成的限制壓縮達
    到最小,因而有利於國家經濟成長或社會安全目標的最大化。Due to no authority for general regulation review, the purpose of this briefing
    paper is to provide guidance by a practical method for regulators to identify important
    competitive restrictions. The guidance uses a set of threshold questions to check
    whether proposed regulations may have significant potential harm to competitions,
    which is then termed as "competition assessment toolkit." A brief summary of
    the competition assessment toolkit is made as a competition checklist, which help
    policymakers review potential competition issues at an early stage in the policy
    development process. Once the checklist shows that situations more likely harm to
    competition, an in-depth competition assessment is required and possible alternatives
    that may minimize potential harm to competition while continuing to achieve the
    desired policy objectives need to be identified. The competition assessment toolkit
    in the paper has no intent to oppose or remove the idea of regulations. Instead, it
    helps regulators to find an efficient way, which minimizes impact on competition
    and then maximizes the benefits of economic growth, social security, or other policy
    objectives.
