    Title: WTO補貼及平衡措施協定規範適用與策略運用之研究

    Abstract: 本研究計畫主要透過彙整分析WTO有關補貼暨平衡措施相關案例中，爭端解決小組（Panel）及上訴機構（Appellate Body）、符合爭端解決機構（DSB）採認建議庭（compliance）對於適用GATT第VI條與第XVI條、WTO補貼暨平衡措施（SCM）協定、農業協定（AoA）相關條文的解釋與定義。透過對於相關案例之法律見解，據以彙析WTO有關補貼之規範。此外，並藉由會員在規則談判小組中，對實行補貼暨平衡措施的疑義或法律爭議之提案。最後，並研析日本、南韓、馬來西亞、新加坡、中國在SCM協定架構下採行補貼措施之策略與通知技巧。
