摘要:	自1993 年起，歐盟完成了一個無內部邊界的單一市場，實現了四大市場自由，而形成一個單一的歐洲金融市場， 2008 年的金融風暴使歐盟體認到建立一個穩固的金融監督體系與風險控管體系的重要性，以在國際金融環境中扮演一個更強勢的『全球角色』。本研究計畫將檢視歐盟自1999 年以來致力於歐洲單一金融市場的各項立法的法律架構，以作為本研究計畫的基礎，將從歐盟跨領域的金融經營模式探討歐洲金融監督體系的形成。第一年以2009 年執委會的歐洲金融監督體系改革提案為主，清楚的呈現未來歐洲金融監督體系的架構。由於金融服務業的跨領域經營模式，涵蓋銀行、保險與證券交易的服務，內容包羅萬象，本研究計畫將限縮研究範圍，以保險業的服務為主，2008 年金融風暴後，歐盟針對保險業資本適足的清償能力修訂公布Solvency II 指令。本研究計畫將以Solvency II 指令對於保險監督的影響進行深入的探討。第二年將以德國安聯保險集團（Allianz）為例進行個案的研究。安聯保險集團為歐洲規模最大的保險公司，集團經營的業務囊括保險、銀行與證券投資的各項金融商品。我國與德國同為大陸法系國家，在外國法的繼受上亦深受德國法的影響。德國金融市場法的發展與形成深受聯盟法的影響，因此第二年將著重於德國保險金融監督體系之研究。 The European Internal Market without borders has been completed since 1993. The European Internal Market has aimed to achieve the four fundamental freedoms within the market. One of results of the Internal Market is to establish a European Single Financial Market. This research project focuses on the legal framework of the European single financial market since 1999 which is the basis of this research project. This research project also works on the establishment of the European financial supervision system in the field of the cross-sector financial business model within the EU. This research project will be undertaken for 2 years. The main topic in the first year focuses on the new European financial supervision system and describing the framework of the European financial system. Insurance industry is one of the important sectors of financial services due to the cross-sector business model. This research project works on the insurance services in the second year. The main research topic is the influence of the Solvency II on the insurance supervision. Allianz Insurance Group will be taken as example which is a German insurance group and the largest insurance group in the EU. Its business extends insurance, banking and securities investment. The EU law has deep and wide influence on the German law. As a consequence, this research project works on insurance supervisory system in Germany.
