    摘要: 歷年來,汽車交通事故已對台灣社會造成重大損害,每年我國汽車交通事故的傷亡人數超過20萬人,常造成人員傷亡及家庭悲劇。其中,「賠償問題」更是關鍵待解決的難題。為解決賠償問題,當事人常生糾紛,而汽車交通事故糾紛案件更是占民事法院侵權行為請求損害賠償案件類型的最大宗。
    為提供汽車交通事故受害人或其遺屬之基本保障,我國自1998年1月1日起即施行「強制汽車責任保險法」,強制汽車責任保險之性質屬責任保險,因此,除了必須保障汽車交通事故受害人或其遺屬外,更應保障被保險人之權益。惟本人發現,目前強制汽車責任保險制度多處尚須修正,否則與民法侵權行為損害賠償相關規定之間將無法銜接、搭配,甚至相互矛盾,將無法真正達到保障受害人或其遺屬之權益,以及免除或減輕被保險人(加害人)之賠償責任。
    因此,本文建議:一、汽車交通事故賠償責任歸責基礎採取危險責任立法模式。二、訂定加害人免責事由。三、修正強制汽車責任保險給付內容與民法侵權損害賠償範圍相同。四、明定強制汽車責任保險給付金額為法定最低保險金額。五、適時提高強制汽車責任保險給付金額。六、重大傷害給付金額可高於死亡給付金額。七、強化並落實暫先保險給付制度。八、修正強制汽車責任保險法所稱請求權人與民法侵權行為損害賠償之請求權人一致。九、修正強制汽車責任保險之保險人不負保險給付責任之規定。十、保險人經營強制汽車責任保險可享有合理利潤。
    期能藉由本文的研究,使強制汽車責任保險制度更健全,進而達到真正保障汽車交通事故受害人或其遺屬及被保險人權益之目的。
    Car accidents have caused serious harm to Taiwan''s society over the years. The number of casualties in car accident is more than twenty millions people. Car accidents often cause casualties and family tragedy per year. The "compensation" is the key problem to be solved. The parties often raw disputes to address the issue of compensation. Disputes automobile accidents account for the largest claim damages in civil court cases.
    For providing the basic protection to car accident victims or survivors, our country has implemented "compulsory automobile liability insurance act " since January 1, 1998. The nature of compulsory automobile liability insurance is liability insurance. In addition to protecting car accidents victims or their survivors, this law also should protect the interests of the insured. However, there are many aspects and provisions of compulsory automobile liability insurance needed to amend. Otherwise, compulsory automobile liability insurance will not converge, or even conflict with civil law related provisions.
    This paper suggests some improvements of compulsory automobile liability insurance as follow. A: the car accident liability attributes to liability legislation; B: the offender exemptions need to be enact; C: the content of compulsory automobile liability insurance amends as covering the same range with compensation for damages in civil law; D: the amount of compulsory automobile liability insurance coverage is the statutory minimum amount of insurance; E: the amount of compulsory automobile liability insurance is raised with proper timing; F: the amount of significant harm may be higher than the amount of death benefit payment; G: the system for provisional payment of insurance benefits should be strengthened and implemented; H: the claimant of the Compulsory Automobile Liability Insurance Act and the claimant of civil law claim for damages should be consistent; I: the insurer of the compulsory automobile liability insurance is not responsible for insurance benefits; J: the insurer of the compulsory automobile liability insurance can share reasonable profits.
    This contribution of paper is reforming more reasonable system of the compulsory automobile liability insurance in order to protect the benefit of car accident victims ,survivors, and the insured.
