    Abstract: 2009年11月16日台灣與大陸簽立了兩岸金融監理備忘錄MOU,兩岸官方正式之金融監理與交流已經啟動。在次年的2010年6月29日在兩岸人民與國際社會下關注期盼的海峽兩岸經濟合作協議ECFA也正式簽署,在我方積極爭取下,早收清單中包含了銀行業設立之優惠條件,兩岸三地原本單向且迂迴的金融往來,現今已可以合法的相互設立金融機構。
    本研究將透過巴賽爾資本協議針對兩岸之金融監理之應用,分析兩岸金融現況與法規,並根據海峽兩岸經濟合作協議的內容,說明兩岸銀行經營的差異,並指出,台資銀行於兩岸金融市場中所面對的挑戰,希望能為兩岸三地的銀行業者提供建議與策略。研究方向從以下角度來分析:
    1.從巴賽爾資本協議來探討兩岸銀行業
    2.從兩岸金融現況來了解現有兩岸的金融法規與業務
    3.從簽訂ECFA簽定後來分析兩岸金融將所面對的機會與挑戰
    MOU was signed On November 16, 2009 which is the begging and official starting relations as well as open markets between the People’s Republic of China(PRC) and the Republic of China(ROC) both government.
    The Economic Cooperation Framework Agreement (abbreviated ECFA) is a preferential trade agreement between the governments of the People''s Republic of China (mainland China) and the Republic of China (Taiwan) that aims to reduce tariffs and commercial barriers between the two sides. The pact signed on June 29, 2010, in Chongqing, was seen as the most significant agreement since the two sides split after the Chinese Civil War in 1949. It will boost the current US$110 billion bilateral trade between both sides. 
    The deal is thought to be structured to benefit Taiwan far more than mainland China. The "early harvest" list of tariff concessions covers 539 Taiwanese products and 267 mainland Chinese goods. The advantage to Taiwan would amount to US$13.8 billion, while mainland China would receive benefits estimated at US$2.86 billion. Mainland China will also open markets in 11 service sectors such as banking, securities, insurance, hospitals and accounting, while Taiwan agreed to offer wider access in seven areas, including banking and movies.
    Following articles of the study is to analyze the present financial status and the relation laws between both sides. According to the agreement of Basel that application in financial overseeing and will also show the different of the bank operation between both sides. Also, it will indicate the challenge that Taiwan local bank will face in the future market and hope will provide some helpful strategies and suggestions for our banks.

    Review the currently relation financial laws and operation between both sides.
    To think and to analyze the challenge and impact for financial market in both sides after signing the ECFA.
