對於身處於資訊爆炸的現在社會裡充滿著各種包羅萬象的情報，國際化的地球村漸成形的現今社會中，傳播媒體產生的影響力也亦趨擴大。而如此活絡且關係密切的新聞媒體之運作，不得不另人重新思考究竟這是否就是人民所想要的？是否仍可有再改進的空間。在如此自由的新聞環境中，對於接收由傳播媒體散播出資訊的國民而言，不禁需要反思究竟表現自由要傳遞的主體為何？傳播媒體對於新聞報導的界限、新聞自由保障的內容為何？媒體為全體國民「知的權利」服務而賦予其報導的自由，若當新聞自由為惡用而致使國民「知的權利」遭受損害，傳播媒體在調適新聞自由與個人權利的保障、增進公共福祉的作為上，及其擔負的責任而言，對於傳播媒體之新聞自由有再次檢視的必要。 本論文當中對於新聞自由的保障內涵的討論，則是藉由對於言論自由與新聞自由的定義，再進一步衍生到新聞自由的範圍、大眾傳播媒體該擁有的公共本質，到近年來出現各種新興媒介的興起及其所衍生之各種課題的探討。然而，近年來的台灣社會當中，由於網際網路此新型態媒體的誕生及媒體生態轉型的時期，媒體報導侵害個人名譽與隱私等權利的事例與日俱增面臨之各種課題的探討。 本論文的構成共計六章，第一章為「緒論」、第二章為「新聞自由之權利基礎」、第三章為「新聞自由之範圍」、第四章為「新聞媒體的公共本質」、第五章為「台灣新興大眾傳播媒體的新聞自由」、第六章為「結論」。本論文欲透過對於大眾傳播媒體重新界定及詮釋，能真正重新喚起對於新聞媒體自由保障的真意。 The core of people’s Right to Know is to know about information from the government. The purpose of this dissertation is to realize the relationship between the media regulations and the protection of expression freedom, and also the influence of the restriction on media. For reaching this goal, this dissertation will discuss the media regulations from the viewpoints of the expression freedom in constitution. However, in recent years, because of the influence of internet, the issues about the aggressiveness done to individual’s privacy and reputation has been increasing more and more. This research is composed of six chapters. The first Chapter is “Introduction”. The second Chapter is “The fundamental theories of the Freedom of the press”. The third Chapter is “The public responsibility of the mass media”. The Forth Chapter is “the Freedom of the press of the new mess media in Taiwan”. The Fifth Chapter is “ The present Condition ot”. The Sixth Chapter is “Conclusion and Suggestions”. After all, this Research makes a comparison about the mass media and the Freedom of press.
