    Abstract: 所謂「軍文關係」指的是軍事領導人與文職領導人的職權運作與決策統屬關係。我國《國防法》與《國防部組織法》兩法通過以後,國軍體制正式回歸「文人領軍、軍政軍令一元化、軍隊國家化、軍政分工專業化」等為取向,以建立二十一世紀的國防願景。雖然國防二法的通過,展現我國國防體制建設的法制化和時代意義,但是國人仍有必要進一步理解「軍文關係」的深層意涵,並藉由美國民主制度與中共共產制度,加以比較分析,進以瞭解軍文關係的發展確保國家安全。
    “Civil-Military Relatio nships”is the operating and commanding relationship between military leader and civilian governor. In order to establish the vision of Taiwan’s national defense in 21st century, the military system beyond the Two Laws of National Defense in Taiwan was redirected to civil-control of military, convergence of the Military Command and Administration Systems, and nationalization of the military. Although Taiwan had established the legality of national defense system and shaping the epochal meaning through “the Two Laws of National Defense,” the domestic members should still understand the deeper meaning of “Civil-Military Relationships.”
    The subject matters of the research are analyzing the cultural background of “Civil-Military Relationships” in USA and PRC as well as implementing and discriminating between them. Furthermore, we also compared the differences in the implementation of military of military administrative management systems, the military command management systems, and the budget/appointing authorities.
    By analyzing and understanding the developments of “Civil-Military Relationships” in USA and PRC, we can further perfect the system of “Civil-Military Relationships” in Taiwan. Within this measure, we can finally structure a stable relationship to ensure Taiwan’s national security.
