    Abstract: 北約為救援科索沃免受塞爾維亞政府之鎮壓、迫害、種族清洗，乃於一九九九年三月二十四日至六月十日間未經聯合國家全理事會的授權，逕直對塞進行人道武力干預，此項軍事行動是否合法？其次要討論的問題是：戰爭已結束，科索沃應否獨立或留在塞國內？第三，科、塞間的基本衝突在於種族權利和歷史權利之訴求，這兩種權利能否同時解決？第四，人權(道)干預是否傷及主權，戰爭行為是否違反戰爭法，最後，推測科、塞間未來的可能關係。本文試就上述問題略作概述與分析。
