    Title: 我國公車動態資訊管理法制化之研究

    Abstract: 交通部公路總局自民國98年度起推動「公路汽車客運動態資訊管理系統建置案」,全國近8,000輛公路客運班車都將納入公車動態資訊管理。系統建置完成後,若再加上先前各地方政府建置的部分,全國所有公共汽車(含公路汽車客運業、市區汽車客運業、交通部公路總局補助地方政府購置之接駁客車)幾乎將完全納入動態資訊管理之範疇。政策推動至此,「法制化」的議題已然無可迴避,故本研究嘗試對此進行探討,將蒐集到的各方觀點投入政策論證並進行分析評估,期能提出若干建議,供主管機關做為未來推動參考。
    本研究利用觀察、訪談、文件分析等方式,蒐集「公車動態資訊管理法制化」之相關資訊以及產、官、學界之評述見解,透過質性分析軟體NVIVO 8加以歸納,共分為「系統內部法規議題」及「系統外部法規議題」等2大群組,包括「主管機關」、「立法精神與目的」、「法源依據」、「系統範圍界定」、「權責分工及操作規定」、「異常事件處理」、「經費來源」、「技術標準」、「審驗制度」、「智慧型站牌」、「車載機拆移」、「罰則」以及「分類營運」、「路線管理」、「站牌管理」、「票務管理」、「班次管理」、「時刻表管理」等18項議題,以William Dunn的「政策論證模式」進行分析,最後發現,在「公車動態資訊管理法制化」的32個政策主張當中,其主要論證模式分別為「說明」模式17個(53.1%)、「動機」模式9個(28.1%)、「類比」模式4個(12.5%)、「價值」模式1個(3.1%)、「權威」模式1個(3.1%)。大多數的政策主張,偏向「說明」與「動機」模式,反應出政策主張者在「可欲性」及「目的性」方面之強度。
    本研究的具體貢獻,在實務界方面,為公車動態資訊管理法制化的議題進行了深入的探討與剖析,為此項討論多時、卻又因為意見複雜而難以具體推動之重要政策,提供了初步的方向,供主管機關參考。在學術界方面,有關公車動態資訊管理的研究,過去主要以績效評估、使用者行為分析為主,本研究則在政策、法制分析的部分,填補了以往的空缺。
    Directorate General of Highways has deployed “Real Time Bus information System” since 2009. Almost 8,000 busses nationwide will be under surveillance. The issue of legalization relating to this system is thus inevitably discussed. This study aims at exploring various perspectives from internal and external sectors on legalization of this system by using policy argument models.
    The problems of legalization of real time bus information system are firstly identified by document analysis, interviews and working meetings. Then with the help of qualitative software NVIVO 8 comments and solutions on this topic are classified into two groups: internal and external legalization issues including authority, legislation philosophy, laws, system definition, responsibility, incident management, finance, technical standard, approval mechanism, intelligent bus stop, installation of on board unit, penalty, classified operation, route operation, bus stop management, fare management, frequency and timetable management. Total 32 policy statements are distributed into 17 “description models”, 9”motivation models”, 4”analog models”, 1”value model” and 1”authority model” by using William Dunn’s policy argument model.
    The contributions of this study fill a missing link of policy and legalization perspectives in the field of real time bus information management which is frequently researched with performance and behavior approaches.
