Abstract:	在現有水資源的分配上，水權主要依河岸權（riparian rights）、專用權（appropriative rights）、容量分享（capacity sharing）、與公共分配（public allocation）等制度或各制度之組合進行分配，然而由於社會與環境變遷，既有之水資源分配大抵不具經濟效率，因此水權若能移轉，將有利於經濟發展以及水資源利用效率之提升。水權移轉須避免對第三者造成影響，既有文獻為避免此第三者效果（third party effects），常將水權設為消費量，但此在最小流量限制緊繃時，由於水權不能由下游移向上游，致使水權交易無法達於最適。本計劃嘗試建立一水權交易制度，寄望透過設計之始初水權分配與交易法則，避免第三者效果，並達成效率性。最後，本研究亦將對水權分配之公平性進行探討。
