| Abstract: | 賭博是人類的天性，古今皆然，中國歷朝歷代雖然採取一連串的禁賭政策，但執行成效有限，總是禁而難止。隨著時代的演進，社會經濟的發展，賭博逐漸呈現出普及化和猖獗化的趨勢，參賭者已涵蓋了社會普羅大眾等各階層。
清代鑒於賭博嚴重影響社會安定，因此制定嚴苛的禁賭政策，但因法令與社會實際生活脫節，法律制度過於僵化、窒礙難行，吏治腐敗、貪污成風等因素，故大多未能落實執行，終成具文，形同虛設；各民間團體、社會組織雖努力配合政府倡言禁賭，但成效有限，終致禁賭政策的失敗。
臺灣現今亦實行禁賭政策，但因未能對症下藥，執法不嚴，地下非法賭博活動猖獗。現在政府已決定要在澎湖等離島地區開放設置觀光賭場（casino），社會各界亦應本著前瞻、成熟的態度，接納此政策，將之納入正常管理方式，加以疏導，並透過完善而周延的立法規範，對於合法賭博，予以嚴格監督管理，以防止弊端發生，除可遏止時下猖獗的賭風外，又可兼具豐盈政府稅收、化解地方財政問題、照顧弱勢、發展地方經濟文化特色等效益。另外對於非法賭博，應參考清代禁賭經驗，修正現行禁賭法令，採取嚴厲取締掃蕩、重懲重罰方式。並加強家庭、學校、社會等倫理道德之教化功能，積極發展各項商品經濟，提高國民生活水平，提倡正當休閒活動。如此，才能解決賭風猖獗問題，對維護社會治安有所裨益。
No matter in the past or at present, gambling is one of the human nature. Although successive gambling-prohibition policies have been used in all the Chinese dynasties, the efforts were in vain. Gambling was prohibited, but is still there. As time goes by, the development of social economy made gambling even more popular and the statuses of gamblers covered all classes of the society.
The Qing Dynasty, due to the serious influence in social security, made strict codes against the gambling. However, these codes did not work because they couldn’t meet the needs of the current society and were too rigid to be enforced. Besides, corrupt bureaucracy also caused the codes impractical. Non-government and other social organizations tried hard to cooperate with government for working against gambling, but they failed.
Gambling is also prohibited in Taiwan nowadays. Nevertheless, the policy is not suitable, and the laws weren’t fulfilled. The illegal gambling activities ran wild. Now our government has decided to set up tourist casinos on the off-shore islands such as Peng-hu legally. Our society should face this policy with foresight and mature attitude. Effective regulation, considered law-making, and strict supervision will be able to increase the tax revenue for solving the financial problems of the government, taking care underprivileged minority, and developing the features of the local economic culture. And, the illegal gambling malady can be prevented as well. The experience from the Qing Dynasty can be learned for amending our current law about gambling. Illegal gambling should be strictly banned. Furthermore, ethic education provided by families, schools, and the society should be improved. Finance as well as citizen’s living standard should be developed. Finally proper leisure activities should be promoted, too. Based on the above measures, the social security can be benefited and the wild gambling problems can be solved. |
