行政職能之日益高漲，而政府組織與人力卻相對地有限，注入民間之力量以改善政府力有未逮之處，實為不可不然之計。全民健康保險總額支付制度實施之後，為了提升醫事服務提供者之專業自主權，中央健康保險局遂透過「自主責任」及「行政與專業分工」原則，而依據政府採購法委託醫事服務提供者團體代表辦理與總額支付相關之專業自主事務。然而，當國家於部分事務上釋出權力予非國家機關時，此釋出權力之過程 ( 程序 ) 與交予非國家機關辦理之事務內容 ( 實體 ) ，便不得不切實謹守規範，以符行政權之民主正當性要求。因此，本文擬對專業自主事務委託契約之內容，及受託者 ( 醫事服務提供者團體 ) 之角色作一分析與探討，視其是否符合行政權民主正當性之要求，並以釐清相關爭議。 Growing to even greater heights of the administrative function, but the official organization and the manpower relatively are actually limited, pours into strength of the folk to improve the insufficient place of the government, actually may not otherwise the idea. So, this paper plans to discuss the content of the Delegation Contract for the Professional Autonomy Affairs of Global Budget System and the role of the medical service providers. And inspect the administration on which whether tally with the demand of the democratic legitimacy for distinguish relevant disputes.
