我國人身保險密度、保險滲透度增加及消費者保護潮流,目前之人身保險爭議解決制度似已無法有效解決人身保險糾紛。 因此,本研究藉由探討美國紐約州保險法之不公平競爭及詐欺交易規範、不公平理賠給付、其他不當行為及不公平歧視條款及保險廳之不公平理賠作業規則、英國金融監督管理委員會之申訴調解人服務處理流程手冊、日本生命保險協會生命保險相談所規程及我國各種人身保險爭議解決制度,予以分析及比較,借助他山之石,求出有效解決人身保險爭議制度重要組成要素。進而針對論文所述及應予調整事項提出建議,以期我國之人身保險爭議解決制度能更有效率。 Since our country life Insurance density and penetration increasing, and consumer protection trending, the life insurance dispute solution system cannot solve life insurance dispute efficiently. Therefore, this research is for the utilization of discussing the unfair methods of competition or unfair and deceptive acts and practices, unfair claim settlement practices, other misconduct, discrimination in New York Insurance law, unfair claims settlement practices of the New York Department in USA, complaint handling procedures of the Financial Ombudsman Service in Financial Services Authority handbook, the Life Insurance Consultation Center rule of the Life Insurance Association of Japan and the life insurance dispute solution system of Taiwan to analyze and compare important elements of efficient life insurance dispute solution system. Moreover, it provides suggestions to the matters, which are mentioned in this thesis and need to be modified. It is hoped that our life insurance dispute solution system could be more efficiency.
