Abstract:	臺灣與中國大陸兩岸分治長達六十年，在當今全球化局勢下，從一開始的敵對狀態，逐漸轉為在經濟貿易上互賴的關係，於是兩岸互動關係逐漸增強。再者，於M型社會底下，中國大陸中下階層人口紛紛尋求外移，且因為臺灣與中國大陸語言及文化差異小，成為大陸人民移入之首選，如此一來，移民問題成為臺灣社會的一大挑戰。近來「假結婚」事件已屢見不鮮，可見移民制度上或是防制犯罪方面值得更進一步探討，如何有效的管理移民人口並防制犯罪事件的發生，成為一項重要的課題。本研究整合歸納研究方法（文獻分析法、深入訪談法），在實證經驗與理論意義之間交織而成，對此社會事實的解釋性理解，獲得受訪者所提供「大陸女子假結婚來臺」的「實地情況描述」與「防制之道探討」下，與「理論」、「實證研究」、「現今法條與規定」建立統合，藉此得以發揮研究結論與建議，讓相關人士及單位有所觸發與警惕。研究發現，茲將「中國大陸女子假結婚來臺之歷程」分為：(一) 仲介過程：打工（同鄉幫忙、仲介集團）；賣淫（接洽過程、仲介費用）。(二) 面談過程：假結婚夫妻接洽過程；為通過面談仲介集團提供的幫助（財力證明、暗中通聯、高科技手法以通過面談）。(三) 找人頭老公過程：接洽過程；人頭老公的獲利。(四)假結婚來臺大陸女子居留臺灣的歷程：為求臺灣證件而忍耐；經濟情況（經濟情況變好、匯錢回家鄉）；住宿；所遇之困難（剝削、夢醒時分、被騙）。(五)返回大陸：未被查獲；被查獲之處境（假結婚被查獲、犯罪被查獲、查獲後再申請來臺的模式）。(六)大陸女子假結婚來臺動機：大陸女子渴望來臺而辦理假結婚來臺之動機（經濟因素、嚮往臺灣）；如何消弭大陸女子假結婚來臺之動機。再者，全面性的由「面談機制」、「勤區查察」、「相關犯案人士懲處」、「針對大陸女子宣導假結婚來臺實務之現象」、「業務編制」、「公務人員廉潔程度」等層面，提出中國大陸女子假結婚來臺之「防制對策」，就我國治安觀點作實務性的探討，提供周邊防制實務人士未來的關鍵決策建議，藉此達成有效防制犯罪之目的。 Abstract: The Cross-Strait between Taiwan and Mainland China has been ruled separately for over six decades. Contemporary globalization has gradually transferred the relations from hostile condition at beginning to now depend mutually in the economical trade. Therefore both governments’ interaction relations strengthen gradually. Furthermore, under the M-Shaped Society, the middle and low social stratum populations seek to immigrate in abundance, and because Taiwan and mainland China have slightly difference in language and cultures, becomes the mainland people’s first choice to immigrate. Then, the immigration problem has become a big challenge in Taiwan society. Recently “the false marriage” event has been common, obviously immigration system or preventing system in crime aspect is worth the further discussion, and how the effective management of the immigrant population and the incidence of crime prevention has become an important issue. In this study, the research method is by means of literature review and in-depth interview and interweaves between the Empirical experience and the theory. Regarding to the interpretative understanding of social facts, the respondents provided access to the “mainland female comes to Taiwan by the false marriage” and "describe the situation on the spot” and "discuss the prevention methods", with “the theory”, “the empirical study”, “the present laws and stipulations” the establishment integration to play an important role to study the conclusions and recommendations, lets be related the public figure and the unit has triggering and vigilant. The research discovered that “the course of mainland China female comes to Taiwan by false marriage” to divide into: (1) Agent process: works (fellow''s help, the agent group); prostitution (contact process, intermediary expense),(2)Interview process: the process of marriage the couple approached; agency’s help to through the interview (financial resource proof, covert communications, high-tech way through the interview),(3) The process of looking for her false husband: contact process; false husband''s earnings,(4) The course of the mainland female comes to Taiwan to reside by the false marriage: In order to have Taiwan credential to endure patiently; The state of business (state of business improves, remit money to return to hometown); Lodging; meets the difficulty (exploitation, dream to awake, deceived),(5) Returns to the mainland: Has not been ferreted out or the pattern situation which after being ferreted out( false marriage to ferret out, crime ferrets out, has been ferreted out, but applies to come to Taiwan again,(6) the motivation of the mainland female comes to Taiwan to reside by the false marriage: the mainland female longed for false marriage to come to Taiwan''s motivation (economic cause, yearn for Taiwan); how to extinguish the motivation of the mainland female using false marriage to come to Taiwan. Besides, integrity by “the face-to-face talk mechanism”, “the duty area investigation”, “the related being arrested public figure punishes”, “propaganda the guidance to the woman leave the mainland to Taiwan by the false marriage on the phenomenon of Practice”, “the task establishment”, “Public Service cleanliness” levels, proposed that mainland China female uses false marriage to come to Taiwan it “prevention strategy”, makes the practical viewpoint discussion on our country public security, will provide people around the prevention of practice recommends that the key decision to the future decision-making in order to achieve the purpose of crime prevention effectively.
