    Abstract: 因市場不景氣,在僧多粥少情況下,唯有價格破壞才能生存,因此,營建業間都流傳「得標靠低價、賺錢靠仲裁」的口語。甚至不肖業者以低價得標後,就鑽契約漏洞,以契約不公平、設計圖說不正確、工程變更程序未規定等為理由提出仲裁以獲利,但這些都是錯誤觀念。唯有技術升級、創新服務及增加研發能力降低成本才是公司的永續經營理念。而仲裁的主要功能在於釐清責任歸屬,面對工程風險所造成的損害,由雙方共同解決工程糾紛。以廠商立場而言是先損失再求償,需先付出成本,再由仲裁判斷得到合理賠償以彌補損失成本。事實上,想以仲裁或訴訟或任何法律手段來獲利,根本是不可能的,頂多只是減少虧損而已。真正獲利都是律師而非正反雙方中之任何一方。
