    Abstract: 我們有色情權利嗎？此為自由主義者與部分女性主義者爭論不休的問題之一。對此，麥肯能 (Catharine MacKinnon) 著名的「噤聲論證」(the silencing argument)，實為值得深入探究的論證之一。依麥肯能的噤聲論證，色情刊物使婦女的言論變得沒有價值，並對婦女產生了「噤聲」(silence) 的效果，因此侵害了婦女的言論自由權利。本文將對麥肯能的噤聲論證中「噤聲」的可能意義作仔細考察。本文將主張：麥肯能的噤聲論證是不假思索的把「遭到噤聲」和「言論自由權利遭到侵害」劃上等號 (本文將稱此為「麥肯能假設」)，而這其實是很有問題的假設。因此，麥肯能並未成功說服我們為何色情刊物侵害了婦女的言論自由權利。
