Abstract:	當代憲法發展趨勢，主要包含下列數點：（1）重視人權保障，（2）確立權力分立制，（3）推動行政民主化，（4）強化違憲審查制，（5）健全政黨政治，（6）落實地方自治。平心而論，我國近年來的憲政改革普遍忽略這些趨勢，甚至與之背道而馳，偶有顧及者，亦如蜻蜓點水，未能切實掌握精髓。其中，有關（1）的部分，歷次憲改皆付諸闕如；有關（2）的部分，牽涉司法院定位問題，於今年7月間舉辦的全國司法改革會議中列入討論，並已達成改革共識。在此，上述二者從略，僅針對國家定位議題及其他部分加以討論。
