    Abstract: "本案甲在作成「撤銷原核發之汽車執照」時,雖然所援引之法律依據為道路交通管理處罰條例第十二條第一項第三款及第二項,與認為係依該條所為之處罰,然究其處分之性質,應屬於依行政程序法第一一七條所為之撤銷原處分的行政處分。對於依行政程序法第一一七條所為之行政處分不服時,應循訴願與行政訴訟之行政爭訟程序救濟。從而丙應對甲所為之「撤銷原核發之汽車執照」的行政處分,依訴願法第一條提起撤銷訴願,於訴願未果時,再依行政訴訟法第四條向高等行政法院提起撤銷訴訟,而非依道路交通管理處罰條例第八七條第一項向普通法院聲明異議。(台北高等行政法院九二訴八七八號判決"
