    Abstract: 本文運用民主課責的概念,指出一個國家在運用特定的中央政府體制時,除了該制度須符合國情與歷史外,更重要的是運作上應符合透明、義務、可控性、責任與回應性等原則,以獲得制度的合理適用。由於法國第五共和是實施雙首長制的典型國家,且三次共治經驗證明該制度確能適應政治生態的變化,因此本文以法國雙首長制為範本,分析該國在憲政規範層次與實務運作層次的精神與內涵。其次,本文探究台灣施行雙首長制的制度落差,雖然在總統權力、總統與行政院長關係,以及行政與立法關係各層面,均出現制度落差,但予以適度添補將有助於未來雙首長制的落實。最後,本文亦指出若能對雙首長制進行正確的制度評價,將有助於該制度的運作獲致更多功效。
    Applying the concept of democratic accountability, this article argues that the operation of government system should conform to the principles of transparency, liability, controllability, responsibility, and responsiveness. As the French Fifth Republic is a typical regime of "double executive" (also known as "semi-presidentialism"), and the three periods of "cohabitation" also show its advantage in adapting to the political environmental change, our primary goal is to analyze the spirit and contents of French double executive regime. Secondly, this article identifies the institutional gaps between French and Taiwan. Although the gaps emerge from every dimension in Presidential power, the relations between President and Premier, and between the Executive Yuan and Legislative Yuan, further institutional replenishment is helpful to apply the double executive regime in Taiwan. Finally, this paper suggests that it is necessary to assess the double executive regime, so its function could be performed much better.
