Abstract:	在明代法律之中，人口買賣是不被允許的。但是透過《（田）辭》所記錄的案件可以發現，許多情況下審判者是承認這項買賣行爲的成立。爲了了解這種非法現象的合法化，筆者擬從「婦女買賣發生之因」、「婦女買賣的種類」、「婦女買賣後的身份」，以及「州縣官的態度」等四個方面，分析《（田）辭》之中的婦女買賣案件。從這些案件之中反映出來的買賣原因，大多是爲了改善貧窮的經濟情況，若審判者阻止這種交易行爲，反而使丈夫再一次將妻子交易出去，以致於審判者只能消極地承認這種交易行爲。
