    Abstract: 在科技爆炸的年代下,智財權重要性不斷的增加,儼然成為未來市場的趨勢。本論文主要討論中國大陸的智慧財產權,在加入世界貿易組織之後的變革。中國大陸身為崛起中的經濟大國,同時擁有大量低廉人工與世界最大市場優勢。在面對歐美國家聯合抵制的情況下,中國大陸的智產權實力仍可以不斷進步;但依照目前的經濟實力與創造能力,中國大陸仍然沒有實力去敵對全世界,因此在謀取進步的同時,如何讓國內的智產權相關法令能夠跟國際接軌,增加自己在國際上的商譽,也是中國大陸極需專注的地方。本研究的主要目的,就是研究中國大陸的智財權在WTO架構下的演進狀況,以及對未來的推演。
    本文利用案例分析,以及交叉比對,來推算中國大陸從1992年宣布加入WTO開始,一直到2016年這24年的時間中,在智慧財產權相關法令所做的改變,配合過去學者專家對中國大陸智慧財產權的相關研究以及發言,來找出中國大陸在專利市場,商標市場以及著作權市場的策略模式,希望對未來在台灣的政策推動上可以提供一個比較明確的方向。
    In the era of information explosion, intellectual property rights have become ever more important and became the trend of the future market. This thesis primarily discusses the changes of mainland China’s intellectual property rights after it joined World Trade Organization. Mainland China is the economic power on the rise; its advantages are its cheap labors and are world’s largest market. Even facing united boycotts from Western countries, China’s IP rights are still gaining grounds. But China’s economic prowess and productivity is still not strong enough to antagonize the world. It became apparent that China needs to focus on how to integrate its intellectual property laws to international standard, improve its business reputation, and while at the same time seek more progress. The purpose of this study will research on China’s IP rights under the WTO frame and its past development as well as its future prospect.
    The method of this thesis will be based on case analysis, and cross-reference on real scenarios. The model will analyze starting from 1992 when China first announced to join WTO until 2016, during these 24 years, the changes of its IP and related laws. This paper will study scholars’ research and speeches on China’s IP progress, to conclude its best market strategy in patent, trademark and copyright. The hope is to offer Taiwan some light of examples in future policy making on these fields.
