本論文研究以兩岸海上搜救機制為焦點,以國土安全概念來進行探討,研究目的有以下三點:1.從國土安全概念探討海巡署之定位與功能。2.從國土安全概念來探討兩岸海上搜救機制。3.研究在兩岸海上搜救機制在發展的前後差異。 本論文首先闡述國土安全概念的緣起與發展,並以國土安全及其中國境管制概念探討海岸巡防署在其中之定位以及功能,並從法制、組織、能量及作為四個層面作為國土安全的標的切入本文,蒐集在國土安全概念的緣起與發展、兩岸海難救助相關之海事法規、組織、能量以及實際執行狀況、臺灣海峽附近搜救案例,透過官方文件、書籍、報章雜誌及網路資訊的描述,以歷史研究途徑及文獻分析法綜合歸納再加以分析。 本論文的研究總結有三點:1.完善我國國土安全網,降低生命財產災害損失。2.從海難搜救法規演化,探究兩岸組織資源整合。3.維護國土安全、培養反恐能量努力。 This thesis has the following three research goals: 1. to explore the position and function of the Taiwan Coast Guard Administration from the concept of homeland security;2. to explore cross-strait maritime search-and- rescue mechanism from the concept of homeland security; and 3. to explore the differences in the cross-strait maritime search-and- rescue mechanism before and after its development. First, this thesis elaborates on the origins and development of the concept of homeland security, and explores the position and function of the Taiwan Coast Guard Administration from the standpoint of homeland security and its concept of border control. It takes as its starting point legal systems, organizations, capabilities, and actions as the four dimensions of the objectives of homeland security; and collects information on the origins and development of the concept of homeland security; related maritime laws and regulations on salvaging, organizations, capabilities, and practical implementation of both Taiwan and China; and rescue cases in the vicinity of the Taiwan Strait. All this information is synthesized and then analyzed by means of historical research approach and documentary analysis in light of the descriptions in official documents, books, newspapers and magazines, and network information. The results of this thesis can be summarized in the following three points:1. to reduce the loss of life and property from disasters by improving Taiwan’s homeland security net; 2. to explore the integration of cross-strait organizational resources in light of the evolution of law and regulations pertaining to maritime search-and- rescue, ; and 3. efforts be made to better protect homeland security and strengthen counterterrorism capabilities.
