    Abstract: 無過失制度與無過失責任制度二者皆係一種損害賠償制度係，惟二者不但因稱呼上僅有隻字之別而易受人誤解，其意涵亦有所不同，在使用上也常為人混用而不自知，導致在某些應用場合裡產生法律規範之間的矛盾或者疏漏。本文嘗試透過損害賠償制度的歷史演進、構成要素及適用場合的差異分析，來釐清此二制度的相異與相同之處，以免遭誤用。
