    Abstract: 我國電子商務產業近來蓬勃發展,儼然成為未來的兆元產業,但是第三方支付業務始終並無對應的法制規範供業者遵循,相較於美國早已於2001年完成第三方支付的專法,日本及中國大陸亦已於2010年完成立法,我國卻遲至2015年2月始由總統公布「電子支付機構管理條例」,立法歷程落後他國甚多。
    為了解我國第三方支付法制中有關消費者權益保護的規範,有無不足或窒礙難行之處,本論文先就第三方支付之特性及運作方式進行分析,歸納出其所主要之風險為「資金管理風險」及「交易安全風險」。再以比較法的角度,分析各國法制對於上開風險的控管方式,最後再聚焦於「電子支付機構管理條例」的各項規定進行分析研究,並提出個人建議。期盼主管機關日後以兼顧產業發展及落實消費者權益保護的方式進行監理,將法制規範與產業趨勢緊密結合,以創造我國整體更有利的電商經營環境。
    The electronic commerce (e-commerce) has been booming so great that become the next trillion-dollar industry in Taiwan; however, there is no corresponding legal regulation of third party payment service for the industry to follow. The U.S.A has already completed the specialized act of third-party payment method in 2001 as well as Japan and Mainland China have in 2010, whereas our legislation has just started, the President announces the beginning of “the electronic payment processing institutions act" in February 2015, which shows our legislation process is far behind many other countries.
    To understand whether there are any inadequate or difficult implementations regarding consumer rights protection within third-party payment platform of our legal system, firstly the study analyzes the features and operation methods of third-party payment and concludes "fund risk management "and" transaction security risk” are the major risks. Secondly, in the light of comparison method, we analyze risk control of corporations’ stock rights within various counties’ legal systems.
    Finally, the study focuses on the authority regulations related to the "electronic payment processing institutions act" and proposes suggestions. We hope the authorities can supervise with taking the future industrial development and implementation of consumer protection into account resulting in a close tie between the legal system and industry trends for creating a more favorable business environment to those companies on internet.
