    Abstract: 兩岸專業交流日益熱絡,大陸地區專業人士申請來臺從事專業交流所涉及的範圍十分廣泛,申請來臺的事由類別原已達25類,然四法整併後之專業交流部分,幾乎已放寬遍及所有之專業類別,其交流之形式、管道和層次也不斷地擴增及提升,對於兩岸關係的影響已逐漸從「量變」轉向「質變」。
    政府循序開放專業交流層面並簡化申請流程,賦予來臺交流之大陸地區專業人士便利的環境下,對於特殊專業性質之交流事由及短期專業交流等,均將專業資格條件及送審文件簡併、簡化,因此涉及「簡併事由、辦證便利」及「強化安全、動態管理」等部分,在現行「大陸地區專業人士來臺交流管理機制」下,是否相對挑戰政府對於處理大陸地區專業人士申請來臺案件審核機制及相關入境程序與人流管理之衝擊影響?管理機制是否仍有其他未臻完善之處?目前所遭遇的困境及因應對策等問題為何?
    因此本文旨在對於上述所遭遇的問題,藉由文獻收集與實務的參與進行研究,以瞭解現行「大陸地區專業人士來臺交流管理機制」,是否出現了不堪負荷的落差,及造成法律規範與現實情狀的不合理矛盾衝突;並嘗試提出修正之策進作為,以歸結對重新建構「大陸地區專業人士來臺交流管理機制」之思考方向及建議,更期待政府能建構一個合理開放、有效管理及落實執行的專業交流管理新機制,以維護兩岸專業交流秩序。
    Cross-strait professional exchange between Taiwan and China is now a booming event of the day. Mainland Chinese professionals have been issued entry permit into Taiwan in the name of professional exchanges under a wide range of circumstances. Prior to the merging of 4 administrative regulations governing the review of Mainlanders Chinese entry permit applications, causes being listed for granting a permit for the purpose of professional exchange were already numbering 29 categories. The new regulation after the merging further relaxes the rules in almost every such category, showing traits of incessant expansion and upgrade mostly in the aspects of activity type, venues of applications as well as the functional level of exchange participants. There is a gradual shift in the way deregulating measures has on cross-strait relations. What used to stimulate the surge of volume of applicants now instigates changes in the essence of exchange activities.

    Deregulation makes room for new dimensions in professional exchanges. Along with efforts to simplify entry permit application, it contributes to a friendlier environment for incoming Mainland Chinese Professionals. With old categories concerning both long-term and short-term professional exchanges being regrouped and application streamlined, new questions arise as to what impact such adjustment may have to the current management mechanism dealing with the matter. Areas of interest involve both the inter-ministerial review system of entry applications and the border passenger flow management system. Further interests arise in whether the current management system warrants room for improvement and whether it is experiencing difficulties to which solutions are in sight.

    This study will investigate the aforementioned issues by means of literature research and practical field studies. It aims to answer whether the current regulations suffices to meet the practical demand. It also looks for signs of conflicts resulting from discrepancy in between the two. To sum up its main perspective and recommendations, the study will formulate a plan for policy revision. It looks forward to see a both effective and efficient measure in place that improves the management of the cross-strait professional exchanges.
