摘要:	國有土地經營管理主要是增加國家資產財富，被視為可貴的黃金資源。全球各地都有土地管理問題，我國亦是如此。而國立大專校院遍佈整個臺灣，其管理之面積大小規模不一，相對管理方式亦有差異，其被占用的土地因地緣及歷史背景也有不同的占用因素。本研究目的是以透過國立大專校院土地被占用的個案，探討土地被占用形成之因素、各校土地管理人員在進行排除占用作業時的遭遇及壓力，藉由管理人員在進行排占時面對占用者的反應及處理情形，期能瞭解學校用地被占用原因，並藉以瞭解現行的管理方式及處理模式，加強改善國立大專校院經管國有土地管理的成效問題。根據本研究結果發現，國立大專校院經管之國有土地被占用原因如下：一、政治、歷史因素所產生的占用。二、各校管理方式對排除占用之立場趨於相同。三、土地閒置，未有效管理所產生的占用。四、弱勢族群無地居身所產生的占用。五、學校及承辦人員態度因素所產生的占用。六、學校承辦人員排占時所承受正反兩方的壓力。土地的管理目標，除了消彌占用形式上的問題，最終主要是達成國有土地的有效利用，有關於國有公用被占用不動產處理原則及要點，歷經幾年的檢討及修正，再對照目前被占用的情形，仍顯示出本相關法規仍有再調整及改進的空間。 The main aim behind the management of state-owned land is to boost nationalwealth; state-owned land is generally viewed as representing a resource of the utmost value. Countries throughout the world are affected by land management problems of various sorts, and Taiwan is no exception. National universities and colleges can be found all over Taiwan; the area of state-owned land that they are responsible for managing varies considerably in size, and there are also significant disparities in the management methods that they employ. The exact reasons why such land may have come to be unlawfully occupied by untitled residents are dependent on specific geographical and historical factors. 　　The goal of the present study is to use case studies of the unlawful occupation of national university land to explore the factors affecting the form that such occupation takes, and the experience of (and pressures felt by) university land management personnel when seeking to remove unentitled residents. It is anticipated that the examination of the response from unentitled residents when university land management personnel seek to remove them, and the ways in which land management personnel deal with such situations, can help to provide a clearer understanding of the factors behind the unlawful occupation of university land, and of the management methods and processing models that are currently used to address this issue, thereby helping to enhance the performance of national universities and colleges when dealing with state-owned land management issues. 　　The results obtained in the present study show that the reasons for unlawful occupation by unentitled residents of state-owned land administered by national universities and colleges include the following: (1)Occupation of land due to political or historical factors. (2)The adoption of similar land management methods (in relation to occupation by unentitled residents) across different universities. (3)Occupation of land due to land being left idle or not being managed effectively. (4)Land occupied by members of disadvantaged minority groups with no homes of their own. (5)Occupation of land resulting from the attitudes adopted by the university or the handling personnel. (6)The pressure experienced by handling personnel when having to evict unentitled residents from university land. 　　Besides eliminating unlawful occupation by unentitled residents, the ultimate goal of land management is to achieve the efficient utilization of state-owned land. The principles and guidelines for dealing with the occupation of state-owned land by unentitled resident have been reviewed and revised over the years; nevertheless, given the current state of such occupation, it would appear that there is still significant room for further revision and improvement of the relevant laws and regulations.
