    Abstract: 本論文透過分析中國現行國內法律制度，探討中國未來正式加入GPA後相關制度可能的變動方向。

    研究目的有三：
    1.回顧國際政府採購法制與中國對外貿易的發展歷程，理解相關制度建立的背景。
    2.分析中國現行政府採購法規的設計，透過條文分析了解制度的特色與存在的缺失，探討現行規範對市場運作可能產生的弊病。
    3.透過比較中國政府採購制度與GPA兩者之差異，預測中國法律制度未來可能的修法方向。

    本論文採用「制度主義」研究途徑，分析標的為中國現行政府採購領域相關之法律規範以及中國現行法規與GPA條文之差異，以期了解中國政府目前對於政府採購領域相關之管理方式、市場運作概況與未來GPA談判進程中可能進行修法的項目。研究方法採用「文獻分析」法，針對政府採購協定條文、中國政府採購相關法律條文、兩岸關於政府採購之期刊論文等學術研究成果以及其他有關政府採購協定之法律見解等資料進行整理與分析。
    The main idea of this study is to explore the possible direction changes of the legal system of China after China join the GPA.
    The purposes of this study include:
    1.Through reviewing the development process of the GPA and China''s foreign trade policy, to comprehend the background of the establishment and related systems.
    2.Through analyzing the China''s legal provisions, to find out the strengths and weaknesses in current markets.
    3.To discern the differences between China''s legal system and the GPA to predict the possible future direction of amending the law of China''s legal system.

    Institutionalism is the research approach in this study. Through compare the differences between the China''s law system and the articles of the GPA, it is expected to gain comprehension of the state of the current market in China and the possible amendments in the future. Documentary Analysis is the research approach to this study, for the GPA articles, the government procurement-related legal provisions in China, the other relevant contents on government procurement, as well as other legal documents of data collection and analysis.
