    Abstract: 本論文研究的大陸房地產制度,包括了土地制度、法律制度、住房制度、調控政策等面向,蒐集相關研究報告及文獻加以彙整歸納,包括房地產制度的定義、發展、運作模式及發展趨勢等,並根據中國大陸官方發佈的統計數據與施政報告,加上業界相關研究或見解,瞭解大陸房地產調控及發展之趨勢,分析其相關問題與對策。

    首先從中國大陸的經濟改革出發,以改革開放後所採行的社會主義市場經濟為理論基礎,從1950年以後開始探討中國大陸政府房地產政策的轉變,而這些轉變帶來了什麼樣的影響,以及宏觀調控中的保障性住房是否能縮短貧富差距。

    整體而言,中國大陸住房制度改革的推進尚稱能對應市場經濟體制發展的要求,並根據社會發展的不同階段給予適時的政策調整。然而在提出住房商品化改革,希望能逐步實現多數家庭購買或承租普通商品住房的同時,由於未有效區分住房政策和房地產政策,基本住房保障相關配套措施缺失、房地產市場缺乏有效的監管,導致人民住房消費能力與房價嚴重脫節,大城市普遍房價上漲過快,形成人民住房問題。目前中國大陸政府調控的重心正逐步向「解決人民住房需求」的目標移動,雖然目前調控效果尚不十分明顯。
    This thesis is studying concerning the system of China real estate including Land system, Justice system, House system, and Control system. Collecting all about research report plus conclude and arrange for documents that including the definition of real estate system, development, mode of the execution and trend of development. The statistics and reports for administration are according from China official in addition to this field''s related research or opinion so that we can understand what is the tendency toward china real estate and the trend of development, analyze related issues and policies.

    First, from china''s economic reformation starts and execute socialism on the basis of thesis after reformation, they have been studying the changes of China real estate since 1950''s and understanding these changes would impact China. Second, they observed the guarantee housing if could shorten the gap between the rich and the poor.

    In sum, China real estate’s promotion is passable meet the standards of market nowadays and keeps appropriate policy adjustments according the different steps of social development. However, on the reformation of commodity housing, they wish the majority families have the ability to buy or rent the ordinary residence houses could be come true step by step. In the same time, due to it ‘s not available to discriminate between housing policy and real estate policy, lack of related supporting measures on the housing guarantee of ordinary residence houses and the real estate market is empty of available administration so that it brings people haven’t enough ability to but the house. Moreover, the price rise-up too fast leads residence problems. Nowadays, the center of gravity of China official is focus on how to resolve the residence problems gradually although the result seems not apparent so far.
