    Abstract: 本論文以「中華民國」政府「批准」《兩公約》,並立法通過《兩公約施行法》爲起點,探討如何以「權利」論重新審視經濟社會文化權利國際公約?經濟社會文化權利國際公約委員會的解釋如何?與此相關的《經濟社會文化權利國際公約》第二條第一項的法解釋如何?至於地方自治體方面,則以日本地方自治體-大阪府的人權實施爲例,探討日本地方自治法下的條例制定,最後以對地方自治體落實經濟社會文化權利國際公約進行分析。
    In this paper, the ”Republic of China” government ”ratified” the International two Covenants on Human Rights, including the International Covenant on Economic, Social and Cultural Rights, legislated ”the law of the implement of the two conventions”, is to explore what the obligations of States parties under the International Convention on Economic, Social and Cultural rights are: how to reexamine the International Convention on Economic, Social and Cultural rights by ”rights” theory? What is interpretation made by the International Convention on Economic, Social and Cultural rights Committee? What is the legal interpretation of Article 2 (1) in the International Convention on Economic, Social and Cultural rights? The above relevant points for the International Convention on Economic, Social and Cultural rights will be addressed.
